Advocate Bhoj Bahadur KC arrested on charge of rape

KATHMANDU, Aug 21: Advocate Bhoj Bahadur KC has been arrested on the charge of rape. He was arrested by the police on Wednesday after being accused of rape by a 48-year-old woman.

An arrest warrant was issued against KC based on the case filed against him in the Thankot Police Circle. KC, however, was admitted to hospital evading the police who came to his house to arrest him.

KC was allegedly suffering from a heart problem and was admitted to the Manmohan Cardiothoracic Vascular and Transplant Centre when the police came to arrest him.

Thankot Police Circle have been unable to detain Bhojbahadur KC due to his alleged heart problem. He will be detained and investigated as soon as his treatment is over, the police have informed.

Habeas Corpus filed before arrest!

Although the Thankot Police Circle obtained an arrest warrant against Bhoj Bahadur KC on the charge of rape, they were not able to arrest him due to his admission to the hospital.

But a habeas corpus was filed in the Supreme Court on August 18 while he was still in the hospital. A writ of habeas corpus was registered by Sharan Mijar from Bhoj Bahadur's side before even being arrested.

On August 20, the single bench of Acting Chief Justice Bishwambhar Prasad Shrestha issued a show cause order to appear in the court along with the captive for a hearing.

If a writ of habeas corpus is issued by the Supreme, the police will have to conduct their investigation without detaining KC.
