Order to bring in opposition in Writ of Min Bahadur and others
KATHMANDU, July 7: An order has been issued to hear the writ filed by Bhat Bhateni supermarket owner Min Bahadur Gurung, former Election Commissioner Sudhir Kumar Shah and others who were arrested in the Lalita Niwas case in the presence of the opposition. After the Central Investigation Bureau (CIB) registered the vacate application in the writ of habeas corpus filed by Gurung and others, it was ordered to hold the hearing together with the opposition.
The CIB arrested Gurung, the owner of Bhat Bhateni Supermarket, for forging government documents in the Lalita Niwas case. Although the CIB said that they were arrested for investigation, the arrested persons filed a writ of habeas corpus in the Supreme Court claiming that they had been illegally detained.
As soon as the arrested persons registered the writ of habeas corpus, the CIB also registered a vacate application in the Supreme Court with the reason why they should be detained and investigated. After the CIB was not informed of the vacate application in the petition filed by Gurung, the court informed the opposition and ordered them to be present on the bench within 24 hours.
Even though the Supreme Court gave such an order on Friday, it seems that the order can only be obtained as quickly as Sunday morning. Since the written answer will be submitted to the court only on Monday after the time starts on Sunday morning, only then will their writ be scheduled for the hearing.
