Property Investigation Commission Continues Work Despite Interim Order

Kathmandu. The Property Investigation Commission, 2083, will continue the process of collecting and investigating the property details of political office bearers and high-ranking employees.

Although the Supreme Court's recent interim order has put a halt on some specific categories of office bearers, the commission clarified through a notice issued on Monday that the investigation work will not stop for other political and public office holders.
The commission, formed by the decision of the Government of Nepal on Baisakh 2, 2083, had a writ filed in the Supreme Court by advocate Dr. Premraj Silwal and others regarding its legality.

Hearing the writ, the Supreme Court issued an interim order on Ashadh 26, directing not to compel judges, the Nepali Army, and certain constitutional office bearers to submit property details immediately and to keep the investigation process in status quo, according to the commission.

According to the notice published by the commission, the Supreme Court's order appears to have primarily provided protection to office bearers related to sub-sections (1) and (2) of Article 239 of the Constitution of Nepal. This includes incumbent judges, Nepali Army personnel, individuals removed from office due to impeachment, judges removed by the Judicial Council, and individuals subjected to action under the Army Act.

The commission's conclusion is that the court has not stopped the investigation for political office bearers and employees other than these specific groups.

The notice issued by the commission states that until a final decision is made by a full bench, the work of collecting property details and preparing reports will proceed as before for all individuals except those specified by the court.

Although the court's order imposed a stay citing potential irreparable damage to office bearers for whom separate provisions exist in the constitution, the commission has stated that it will remain active within its scope of work for the general political leadership and administrative employees.

The commission has also informed all concerned to participate in the prescribed process.
