Supreme Court Refuses Interim Order on Agricultural Company Assistant Manager Post

Kathmandu. The Supreme Court has refused to issue an interim order, determining that the minimum educational qualification sought for the Assistant Manager (Plant Operator) post at the Agricultural Inputs Company Limited and the applicant's qualification did not match. 

A joint bench of Justices Kumar Regmi and Shreekant Poudel issued the order on Tuesday.

The Agricultural Inputs Company Limited had published an advertisement on March 20, 2020, inviting applications for the post of 'Assistant Manager (Plant Operator)'. The educational qualification for the post was specified as a bachelor's degree in Mechanical Engineering or equivalent.

Applicant Amit Kumar Singh had applied for the post. However, the company rejected his application, stating that his educational qualification was 'Agricultural Engineering'. Singh filed a writ petition in the Supreme Court, claiming that his application was rejected despite being in order.

After hearing both parties, the court pointed out that the advertisement clearly sought an engineer for plant operator-related work, and for that, Mechanical Engineering was necessary. The order states, 'As it is evident from the name of the post that an engineer for plant operator-related work is required, and from the applicant's claim that his educational qualification is Agricultural Engineering, it is seen that the specified minimum educational qualification is different, and thus the applicant's application was rejected. Therefore, in the interest of balance, an interim order cannot be issued.'

With this, the applicant will not receive immediate legal relief due to not meeting the specified technical qualifications.
