Debate notes demanded from Supreme Court in writ against Bamdev Gautam
KATHMANDU, April 27: The bench has asked for debate notes in the writ filed saying that the decision to nominate Bamdev Gautam, who was defeated as a member of the House of Representatives, to the National Assembly in the same term is in conflict with the Constitution. On Wednesday, the constitutional bench ordered to demand debate notes in the writ against Bamdev Gautam.
Senior Advocate Dinesh Tripathi, Advocate Badriraj Bhatta and others filed a writ petition in the Supreme Court saying that the recommendation of the then KP Sharma Oli government to nominate Bamdev Gautam who was defeated from Bardia as a member of the National Assembly was against the constitution.
In the writ registered on Asoj 12, 2077, an order was given to demand the debate notes for the eighth time. On Wednesday, the Constitutional Bench of the acting Chief Justice Harikrishna Karki, Justices Bishwambhar Prasad Shrestha, Ishwar Prasad Khatiwada, Dr. Anand Mohan Bhattarai and Anil Kumar Sinha ordered to demand the debate notes after the final hearing.
After demanding the debate note from the writ petitioners, the petitioners have prepared the debate notes. The writ petitioner sought an interim injunction demanding that the National Assembly member not be sworn in, but the Constitutional Bench of the then Chief Justice Cholendra Shamsher Jabara, Justices Deepak Kumar Karki, Harikrishna Karki, Vishwambhar Prasad Shrestha and Ishwar Prasad Khatiwada refused to grant the interim injunction and ordered the entire document to be produced. After the interim order was not issued, then President Bidya Devi Bhandari nominated Gautam as a member of the National Assembly.
If the Constitutional Bench decides that the person defeated as a member of the House of Representatives will not be nominated as a member of the National Assembly at the same time, the position of the National Assembly member of Bamdev Gautam will be revoked.
