The hearing on Koshi province government adjourned

Kathmandu: The hearing regarding the Koshi provincial government case has been postponed. Sunil Kumar Pokharel, one of the three judges on the full bench, declined to proceed with the hearing due to his previous involvement in the Koshi dispute. Chief Minister Hikmat Kumar Karki's advocate, Tikaram Bhattarai, questioned Pokharel's ability to hear the case, leading to his decision to withdraw after deliberation with other judges.

The hearing, initially scheduled for Sunday, involved a writ against the Koshi Province government, with the full bench consisting of judges Prakash Kumar Dhungana, Abdul Aziz Musalman, and Pokharel. Previously, a joint bench comprising Supreme Court Justices Til Prasad Shrestha and Balkrishna Dhakal had referred the case to the full bench last Wednesday.

The writ petition, filed by Kedar Karki, seeks an interim order alleging that the appointment of a Chief Minister violated the Constitution by not removing the previous CM from office. The former CM, appointed under Article 168 of the Constitution, was ousted based on a resolution proposal from the Provincial Assembly. Additionally, reasons for his removal from the office was the withdrawl of support from UML Provincial assembly members and his failure to garner the vote of confidence.
