Upendra Yadav's Writ Petition Hearing Postponed
The case filed by Janata Samajwadi Party Nepal (JSPN) President Upendra Yadav against the division of his party could not be heard on Tuesday either.
The hearing scheduled in the bench of Judges Kumar Regmi and Til Prasad Shrestha has been adjourned. Yadav's writ was at number 23 in the series of cases to be heard today.
Ashok Rai along with other leaders petitioned to the Election Commission to register his own party after splitting from JSPN. The Election Commission registered a new party under the leadership of Ashok Rai. But Yadav filed a petition in the Supreme Court claiming that it was illegal to register another party on the basis of the application given by the leaders who left his party.
Similarly, Yadav also filed another writ in the Supreme Court demanding that the seven MPs who left JSPN be stopped from working as MPs. Although the bench was appointed to hear both the writs together, the judges did not schedule them for the hearing. Earlier, the hearing on 14th of June was also postponed as it was not possible to run the court proceedings regarding the case.
Earlier, the bench had issued a short-term interim order in favor of Yadav. Although the order was issued in the first hearing, the Rai side gave a vote of confidence to Prime Minister Pushpa Kamal Dahal alias Prachanda. But functioning as a party has been stopped by the court order.
