Case against Rabi Lamichhane will not be heard

KATHMANDU, April 4: The case against Rabi Lamichhane, President of the Rashtriya Swatantra Party, will not be heard. 

Judge Anil Kumar Sinha's bench will not hear the case as the case against Lamichhane was heard by Sinha before this as well. The writ registered on Monday was placed on the list of hearing for Tuesday.

Yuvaraj Paudel, also called Yuvaraj Safal, filed a writ in the Supreme Court on Monday with the demand that the case of passport misuse be initiated against Rabi Lamichhane. Along with this, the case will be heard on the next day only.

Yuvaraj Paudel himself filed a complaint at the District Police Range Kathmandu as Lamichhane used a double passport and that it is an act and a crime against the constitution and law and has demanded immediate investigation and action.

Lamichhane, who contested the election as a member of the House of Representatives using the previously revoked citizenship, won in Chitwan-2. But the Supreme Court said that a person who is not a Nepali citizen participated in the election and even won, so his position as an MP and the election process itself was annulled. 

Now the By-election is being held in Chitwan Constituency No. 2 on the 23rd of April where Lamichhane is a candidate. Yuvaraj Paudel has demanded action claiming that Lamichhane is violating the laws of the constitution that it has not yet become 3 months after Lamichhane re-issued his Nepali citizenship, but still is taking part in the By-election as a candidate.
