Supreme Court initiates hearing on HoR dissolution writs

KATHMANDU, May 27: Hearing on the writ petitions registered at the Supreme Court against the dissolution of the House of the Representatives (HoR) has begun today. The hearing is taking place at the single bench of the Chief Justice Cholendra Shamsher JB Rana. 

The hearing is underway on the 19 writs registered at the apex court seeking interim order against the dissolution of the HoR.

However, other 11 writ petitions assigned at the Constitutional Bench will begin on Friday.  The hearing of the writ petition registered by the outgoing 146 lawmakers is also scheduled for Friday.

The 26 writs have demanded for restoration of the parliament while four have demanded for the reappointment of KP Sharma Oli to the post of the Prime Minister.

The four writ petitions have demanded reappointment of CPN (UML) Parliamentary Party leader Oli as Prime Minister. 

One hundred forty six outgoing lawmakers including Nepali Congress President Sher Bahadur Deuba, Chairperson of CPN (Maoist Centre), the then leader of CPN (UML) Madhav Kumar Nepal, Chairperson of Janata Samajwadi Party Upendra Yadav and leader of Rastriya Janamorcha Durga Poudel have demanded that NC leader Deuba becomes new Prime Minister. 

The writ petition filed by the lawmakers has demanded that NC leader Deuba becomes new PM in line with Article 76 (5) of the constitution and the HoR be reinstated. 

Other demands include annulment of President’s dissolution of the HoR on May 22 on the Cabinet recommendations and the President’s act should be termed unconstitutional and illegal.
