Vacate petition filed against SC’s interim order not to form Constitutional Bench without Chief Justice

KATHMANDU, September 3: An advocate has filed a petition demanding to vacate the Supreme Court (SC)’s order not to form the Constitutional Bench without the Chief Justice on Friday. 

Senior advocate Dinesh Triphati filed a vacate petition at the apex court on Friday.

According to Senior advocate Triphathi, the supreme court will study the petition before its registration.

Earlier on Thursday, Justice Hari Phuyal issued an interim order not to conduct the hearing of a petition filed in the apex court regarding Constitutional Council and appointment made on its bases under the bench of Justice Bina Magar. However, Thitpathi has claimed that the Constitutional Bench cannot be barred from conducting its duties.

Similarly, earlier on Friday, Chief Justice Cholendra Shumsher JBR had agreed to grant responsibility for arranging the hearings to Senior Justice Depak Kumar Karki. Likewise, CJ Rana also announced not to be a part of Constitutional Bench hearing cases related to appointments in constitutional bodies.
