Same person can’t be PM under all constitutional provisions in single tenure: Bhimarjun Acharya

KATHMANDU, June 27: Constitutionalist Bhimarjun Acharya has said that the same person can be appointed as the prime minister exercising all the possible constitutional provisions in a single tenure. 

Participating in the ongoing debate on writ petitions against the dissolution of the House of Representatives (HoR), on Sunday, advocate Acharya argued that Prime Minister KP Sharma Oli should have taken a vote of confidence from parliament within 30 days as per Article 76 (4) of the Constitution of Nepal. 

Acharya was of the view that no next clause of Article 76 is activated unless carrying out the necessary procedures as provisioned in Article 76 (4). He also said that no political party can issue a whip to its lawmakers as per Article 76 (5).
