Writ petition filed at SC seeking legal recognition of live-in relationships

KATHMANDU: Advocate Annu Bhattari has taken a decisive step by submitting a writ petition to the Supreme Court, advocating for the formal recognition of cohabitation arrangements.

The petition underscores the urgent need for a regulatory framework that validates the status of couples meeting specific legal criteria to engage in cohabitation relationships. Despite the prevalence of such unions, Nepal currently lacks clear laws and guidelines governing them.

Bhattari draws attention to the increasing trend of youth involvement in cohabitation, particularly in urban settings, which often presents various societal and legal challenges.

In response to these pressing concerns, the petitioner urges government action towards enacting legislation tailored to address cohabitation dynamics. Additionally, the petition delves into the eligibility criteria for individuals entering such partnerships, emphasizing the importance of recognizing unmarried individuals over 18 years old, as well as those who are divorced, widowed, or single, regardless of gender, for cohabitation rights.

Furthermore, the petition underscores the critical necessity for a comprehensive legal framework governing the dissolution of cohabitation relationships, ensuring equitable outcomes in cases of mutual agreement or coercion.
