Acting Chief Justice Orders Registration of Recommendation Against Chief Justice

Kathmandu. Acting Chief Justice Sapana Pradhan Malla has ordered the registration of the petition filed against the recommendation for Chief Justice and to set a date for hearing.

The writ petitions filed separately by senior advocate Dinesh Tripathi, advocate Geeta Thapa and Premraj Silwal, raising questions about the legality of Sharma's recommendation, were rejected administratively on May 8, and a rejection order was issued.

According to writ petitioner Dinesh Tripathi, after drawing the attention of Acting Chief Justice Malla, an order has been issued to register the petition against the rejection today and to set a date for hearing tomorrow.

In her written order, Acting Chief Justice Malla stated, 'It appears that stopping a petition that has come to be registered in the court as per the procedure and process prescribed by law is an obstruction to obtaining justice and a behavior and effort to increase distrust in the public's faith in the court.'

She also mentioned in her order that when the attention of the Chief Registrar was drawn to the judges, it was informed that it was not done because the recommended Chief Justice (Dr. Manoj Kumar Sharma) himself had given instructions.

She mentioned that it has become a situation where it is necessary to issue necessary instructions and orders in her capacity as Chief Justice, in accordance with Article 136 of the Constitution of Nepal, Section 35 of the Judicial Administration Act 2073, and Rule 7 of the Supreme Court Regulations 2074.
