Actions taken by president also fall under court's jurisdiction: Advocate Bhattarai
KATHMANDU, June 25: Advocate Tikaram Bhattarai has made it clear that the constitution does not say that the actions taken by the president are not the subjects to judicial review.
While taking part in a debate against the dissolution of the House at the constitutional council on Friday, Bhattarai claimed that the President Biday Devi Bhandari sent a reply to the court as if she had forgotten the signature she had made while drafting the constitution.
Advocate Bhattarai made the argument on behalf of the writ petitioner during the debate on the writ petition registered against the dissolution of the House of Representatives (HoR) on May 22.
"Even the actions of the military court also fall under the jurisdiction of the Supreme Court," he said.
He was also of the view that the president does not have the right to not appoint anyone as prime minister as long as the parliamentarians lay claim to the position. “If she [President Bhandari] fails to do so, it means she abstains from fulfilling the responsibilities envisioned in the constitution,” he added.
