Supreme Court relieves Krishna Thapa of Gandaki Province Assembly membership
KATHMANDU, June 14: Krishna Thapa's membership in the Gandaki Province Assembly has been annulled as the Supreme Court (SC) ordered not to implement its earlier interim-order passed on June 6.
A division bench of justices duo Bishwambhar Prasad Shrestha and Kumar Regmi issued the order to revoke its June 6 order to reinstate Thapa, as per the Supreme Court Regulations-2017. The order stated that there is no dispute in the fact that the circumstance has changed after the interim order was issued by the court as Thapa was relieved from the membership of the assembly.
With this, Thapa, who was elected from the Rastriya Janamorcha (RJM) from Baglung district, lost the membership of Gandaki Province Assembly.
Earlier on June 6, the apex court issued an interim order to allow Krishna Thapa, who was suspended as the Gandaki Province Assembly member, to discharge his duty as the province lawmaker. A single bench of Justice Dr Kumar Chudal issued an interim order to allow Thapa to work as a member of the provincial assembly. The bench ruled that Thapa should not be removed from the post of member of Gandaki Province Assembly as per Article 35 of the Political Parties Act-2017.
Thapa, was suspended as the province assembly member after he refused to support the chief minister candidate proposed by the opposition alliance on May 12.
