PM’s claim over execution of Article 76(5) is unconstitutional, say four former Chief Justices
KATHMANDU, May 28: Four former Chief Justices have said that the dissolution of the House of Representatives and ‘improper’ implementation of the constitution has posed a threat to the existence of the Constitution of Nepal.
Issuing a joint statement on Friday, former Chief Justices Min Bahadur Rayamajhi, Anupraj Sharma, Kalyan Shrestha and Sushila Karki said that the recent practices while exercising Article 76 of the constitution go against the letters and spirit of the constitution and democratic norms and values.
The former Chief Justices said, "The constitution, democracy and conscience do not allow anyone to continue in office and exercise all the powers of a legitimate government even after failing to win a vote of confidence from parliament time and again."
