Supreme Court orders release of Durga Prasai's bodyguards
KATHMANDU: The Supreme Court (SC) has issued an order for the immediate release of two bodyguards of medical entrepreneur Durga Prasai, who were detained earlier.
In a ruling by a divisional bench comprising Justice Nahakul Subedi and Sunil Kumar Pokharel, the SC directed the release of Ramkumar Dhimal and Deepak Khadka, the bodyguards of Prasai, who were apprehended while in possession of weapons.
The order emphasized that carrying arms in accordance with the conditions of an arms license does not constitute an offense under prevailing laws. Therefore, the arrest of the petitioners under Section 132 of the Criminal Code Procedures, 2074 BS, and their subsequent remand by the Kathmandu District Court were deemed illegal.
The apex court has instructed the revocation of all necessary arrest warrants, detention warrants, extension orders, and letters issued to the petitioners. Furthermore, it ordered the immediate release of the petitioners from unlawful detention.
Dhimal and Khadka were arrested by the Nepal Police on March 18 while they were attempting to enter the Supreme Court premises.
