Supreme Court's refusal to issue interim order on Koshi Chief Minister's appointment
KATHMANDU, July 12: The Supreme Court has refused to issue an interim order in the writ filed against the appointment of Uddhav Thapa as the Koshi Province's Chief Minister. The single bench of Justice Sapana Pradhan Malla issued a show-cause order and refused to issue an interim order on Wednesday.
The outgoing Koshi Province Chief Minister Hikmat Karki filed a writ petition on Friday against the newly elected Chief Minister Thapa, Provincial Chief Parshuram Khapung and Speaker Baburam Gautam.
Karki claimed that in accordance with Article 168 (2) of the Constitution, including the Speaker while appointing the government is against the Constitution.
In accordance with Article 168 Clause 3 of the Constitution, the outgoing Chief Minister Karki requested a mandate to appoint himself as the Chief Minister as the leader of the largest parliamentary party in the Provincial Assembly.
