Chitwan-2 by-election: Can Rabi Lamichhane be a candidate again?
KATHMANDU, Feb 13: The government has decided to hold a by-election at Chitwan-2 on April 23.
A meeting of the Election Commission held on Sunday took a decision to this effect.
Rabi Lamichhane who was earlier elected a member of the House of Representatives from Chitwan-2 lost his position after the Supreme Court declared his citizenship illegal. Soon after the apex court’s decision, Lamichhane reacquired his citizenship which has now raised questions regarding his eligibility to be a candidate in the upcoming by-election.
Meanwhile, Lamichhane is preparing to contest from Chitwan-2 again.
According to senior advocate Sathish Krishna Kharel, Lamichhane can now contest in the election as he has already recovered his citizenship. “The government has already provided citizenship to Lamichhane, so now there is no legal barrier for Lamichhane to be a candidate.”
The District Police Office, Kathmandu is currently conducting an investigation on Lamichhane’s passport case. As per section 13 of House of Representatives Election Act, 2074 (2017), if anyone is found guilty in misusing a passport, then he/she can be declared ineligible to be a candidate to contest in the election.
According to the Article 84 (7) of the Constitution of Nepal, in case the seat of any member of the House of Representatives falls vacant while its term still remains for more than six months, the vacancy shall be fulfilled in the same manner of electoral system as in which such seat was fulfilled.
