SC making final preparations to introduce lottery system to schedule cases

KATHMANDU, November 18: The Supreme Court is making its final preparations to introduce a lottery system to schedule cases for hearings.

The majority of justices of the apex court has demanded a full court meeting in this regard. A meeting of 14 justices of the apex court held on Wednesday decided to demand a full court meeting.

Justices, who have been boycotting the benches for the past three weeks, have finally begun hearing the cases citing that the country cannot bear further judicial deadlock and need amendments in the judiciary.

According to a justice, the major controversy in the apex court is the way in which the cases are scheduled. So, the justices have demanded a lottery system for scheduling the cases.

Currently, there is a rule of scheduling the cases for hearings by the chief justice at the apex court. But, if the lottery system is introduced, the cases will be scheduled as per the lottery number picked by justices.

Even Though the chief justice Cholendra Shumsher JB Rana seems unwilling to summon a full court meeting, he is compelled to do so if the majority of justices are in its favour, according to the SC. 

However, the right to summon a full court meeting has been vested to the chief justice in Nepal and a full court meeting cannot be held in the absence of the chief justice. So, the question still remains what happens if CJ Rana is not willing to call a full court meeting?
