SC rejects advocate Tirpathi’s petition to vacate SC’s interim order not to form Constitutional Bench without CJ
KATHMANDU, September 4: The Supreme Court (SC) has rejected a petition filed to vacate its interim order asking not to form the Constitutional Bench without the Chief Justice Cholendra Shumsher JBR.
Senior advocate Dinesh Triphati filed a vacate petition at the apex court on Friday.
Stating that petitioner (Triphati) is not a ‘stakeholder’ to the petition, the apex court has rejected his petition.
According to Babu Ram Dahal, spokesperson for the apex court, there Tripathi can not file the vacate petition filed as he does not have any connection with it. “Triphati neither is in its favour nor against, so his petition has been rejected as per SC’s regulation.”
However, advocate Triphati has not said anything regarding rejection of his vacate petition.
Earlier, Chief Justice Cholendra Shumsher JBR had agreed to grant senior most Justice Deepak Kumar Kartki with the authority of assigning cause lists and to lead the bench. Likewise, CJ Rana also announced not to be a part of Constitutional Bench hearing cases related to appointments in constitutional bodies.
