Ghimire, KC recommended as amicus curiae for HoR dissolution case

KATHMANDU, June 15: The Supreme Court Bar Association has finalized the members of the amicus curiae to help the Constitutional Council with the case relating to dissolution of the House of Representatives sub judice in the Supreme Court (SC). 

Senior advocates duo Komal Prakash Ghimire and Prakash Bahadur KC have been recommended as the part amicus curiae which is supposed to extend its opinion on the case  which is under consideration at  the apex court.

An executive meeting of the Supreme Court Bar Association held under the chairmanship of its Chair Purna Man Shakya today took a decision in that regard, according to the Bar member Bikash Bhattarai.

The Supreme Court Constitutional Bench that is currently hearing the case sought two members each from the Nepal Bar Association and Supreme Court Bar Association as the Amicus Curiae.  Regular hearing on the case is scheduled to resume from June 23.

It is to be noted that President Bidya Devi Bhandari, at the recommendation of the KP Oli-led Cabinet, dissolved the House on May 22. It is the second time in five months that the lower house got dissolved. Earlier, the Supreme Court’s Constitutional Bench had restored the House, which was dissolved on December 20, 2020, on March 7.

Asx many as 26 writ petitions have been filed at the apex court demanding it reinstate the 275-member lower house of parliament, while four other petitions have asked the court to issue an order to appoint KP Sharma Oli as the prime minister as per the Article 75 (5) of the Constitution of Nepal. 

A five member Constitutional Bench comprising SC justices Dipak Kumar Karki, Mira Khadka, Ishwar Prasad Khatiwada and Anand Mohan Shrestha  headed by Chief Justice Cholendra Shumsher JBR was formed to hear the case.
